Please read this agreement carefully before accessing or using the information and services available through the mycontractor.com.au website ("Site"). By accessing or using the Site, you agree to be bound by the terms and conditions below. mycontractor.com.au may modify this agreement at any time, and such modifications shall be effective immediately upon posting the modified agreement on the Site. Contractors Terms and conditions must be accepted and adhered to by Contractors who use the mycontractor.com.au services and the Site.

INFORMATION FOR PERSONAL, NON-COMMERCIAL USE ONLY
You agree that information contained on this Site is for personal use only and may not be sold or redistributed. You may download material from this Site for your personal, non-commercial use only, provided you keep intact all copyright and other proprietary notices.

You may NOT modify, copy, reproduce, republish, upload, post, transmit or distribute in any way any material from this Site including code and software. You must not use this Site for any purpose that is unlawful or prohibited by these terms and conditions.

You acknowledge and agree that information published by mycontractor.com.au is intended to provide general information about the contractor.  mycontractor.com.au will not take responsibility for incorrect or misleading information uploaded by contractors.

mycontractor.com.au does not endorse or recommend any of the contractors on its Site and mycontractor.com.au strongly recommends that prior to entering into any agreement with any of the contractors on the Site, that you obtain your own independent legal, accounting, financial or taxation advice as appropriate. It is solely your responsibility to evaluate the accuracy, completeness and usefulness of all certification, services, merchandise and other information provided through the Site or on the Internet generally.

In no event will mycontractor.com.au be liable to you or anyone else for any decision made or action taken by you or anyone else in reliance upon any information contained on or omitted from the Site.

USE OF INFORMATION
By registering your details with mycontractor.com.au, all contractors and individuals are consenting to receive marketing materials from mycontractor.com.au and its affiliates.

Contractor Information will in line with the terms of our privacy policy, and used for the following primary purposes:

 -  To fulfil obligations under any sale and purchase contract and/or any other contract between the customer and mycontractor.com.au .
 -  To provide information about products, service and/or special offers.
 -  To obtain opinions or comments about products and/or services.
 -  To record statistical data for marketing analysis.
 -  For the purpose described above, information may be shared with mycontractor.com.au and it’s affiliates. 

Also, in order to operate the Site or deliver a service, professional contractor information may be shared with prospective customers, service provider or other non-HomeSource company or professional.

mycontractor.com.au may contact you via telephone, SMS, email, post or any other form of electronic or conventional communications channel using the information provided in order to:

 -  Provide you with reminders that your compliance requirements are not up to date.
 -  Provide information about updates, new products and services, special offers and other matters that may be of interest.
 -  Send newsletters or other communications materials.

Please be advised that as a member of the mycontractor.com.au community you will receive email reminders about your compliance status - and you cannot opt out of these. However, if an individual receives communications from mycontractor.com.au its partner or affiliates which they do not wish to receive, they may remove their name from the marketing database by contacting mycontractor.com.au at support@mycontractor.com.au. Please allow 14 days for this request to be processed.

NO SERVICE GUARANTEES
mycontractor.com.au provides no warranty to you that the services generally available through its Site will be uninterrupted or error-free or that defects in the service will be corrected. You also understand that mycontractor.com.au cannot and does not guarantee or warrant to you that files available for downloading through the Site or delivered via electronic mail through the Site will be free of infection or viruses, worms, Trojan horses or other code that manifest contaminating or destructive properties. You are responsible for implementing sufficient procedures and checkpoints to satisfy your particular requirements for accuracy of data input and output, and for maintaining a means external to the Site for the reconstruction of any lost data.

OWNERSHIP OF DATA, SOFTWARE AND GENERAL INFORMATION
Any data and software owned by mycontractor.com.au are leased to the Client and remain the property of mycontractor.com.au  The Client will provide and transmit to the system software, data and content to be uploaded to the servers and accessed by the general public via the Internet. Upon termination of this agreement, The Client agrees to take a copy of their “watchlist” data prior to the termination date of the contract. mycontractor.com.au will not be responsible for providing access or copies of the data or content stored on the system after the final termination date.

MYCONTRACTOR'S RIGHT TO SUSPEND OR CANCEL ACCOUNT
mycontractor.com.au reserves the right to suspend or cancel service to a Client at any time and without notice, for any reason, including, but not limited to, refusal or failure to pay for services provided or by sole judgment of mycontractor.com.au that the Client may be performing activities harmful to mycontractor.com.au or its Clients, employees, vendors, business relationships or any other users of the Internet.

YOUR RESPONSIBILITY FOR YOUR PASSWORD AND LOGIN
You and Your nominated representative(s) are solely responsible for the confidentiality and use of Your Logon ID and Individual Logon ID. You will notify mycontractor.com.au immediately if you become aware of any loss or theft or unauthorised use of Your Logon ID or any Individual Logon ID or any part thereof. After such notification mycontractor.com.au shall as soon as reasonably possible disable access and Services for such Logon ID or Individual Logon ID and shall issue a replacement Logon ID or Individual Logon ID accordingly.

mycontractor.com.au is entitled to assume that any instruction received containing all or any part of the Logon ID or Individual ID originates from you or the authorised representative to whom the Logon ID or Individual ID is assigned and that such instruction is a valid instruction.   mycontractor.com.au is not obliged to inquire into the validity of any such instruction received.

mycontractor.com.au deems that the person using an Individual Logon ID or any part of it to access the Trading Site and the Services is the person to whom the Login ID is assigned to.

INDEMNITY
You must indemnify and hold harmless mycontractor.com.au and mycontractor.com.au Personnel and keep them indemnified, against all loss, actions, proceedings, costs, expenses (including legal fees), claims and damages arising from:

(a) any breach by you of the General Conditions; or
(b) reliance by you on any information obtained through the Site; or
(c) your Access to the Site; or
(d) reliance upon or use of any Content by any person accessing any Content through your web site.

PAYMENT AND INVOICES
mycontractor.com.au does not extend credit to the Client. All services must be paid for in advance of service delivery. All fees must be paid in Australian currency. For monthly payments, payment is due at the beginning of each monthly period. Annual payment is due at the beginning of each annual period.
All quoted prices are exclusive of GST.

It is the responsibility of the Client to ensure that full fees are paid to mycontractor.com.au recognising that failure to do so could cause service interruption.

WARRANTIES AND REPRESENTATIONS
mycontractor.com.au is not responsible for data or content maintained and distributed by my contractor facilities. The services are provided on an "as is" basis and client's use of the services is at its own risk. mycontractor.com.au does not make, and hereby disclaims, any and all other express and/or implied warranties, including, but not limited to, warranties of merchantability, fitness for a particular purpose, noninfringement and title, and any warranties arising from a course of dealing, usage, or trade practice. mycontractor.com.au does not warrant that the services will be uninterrupted, error-free, or completely secure.

GOVERNING LAW
These General Conditions are governed by, construed and enforced in accordance with the laws of New South Wales, Australia. Disputes arising from these General Conditions are subject to the exclusive jurisdiction of the courts in New South Wales, Australia.
